These Terms of Use (the “Terms”) govern access to and use of the Scalyz platform, available through the website and associated applications (the “Platform” or "Scalyz").
By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to comply with these Terms.

1. Acceptance of Terms

Access to the Platform is subject to full acceptance of these Terms.
If you are using the Platform on behalf of an organization (including as a recruiter), you represent and warrant that you have the authority to bind that organization to these Terms.

2. User Accounts

• Creation: Certain features of the Platform require the creation of a user account. You agree to provide accurate, complete, and up-to-date information.
• Confidentiality: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account.
• Responsibility: Any unauthorized use of your account must be reported immediately to Scalyz.

3. Use of the Platform

Purpose: The Platform is intended for IT skill validation through immersive labs.

Authorized uses:

• Talents may use the Platform to participate in immersive labs and obtain validation reports.
• Recruiters may use the Platform to invite talents to complete immersive labs and receive the corresponding results.

Prohibited activities: You shall not use the Platform:

• for unlawful, fraudulent, or unauthorized purposes;
• to interfere with, disrupt, or compromise the integrity or security of the Platform (including unauthorized access, data scraping, or reproduction of content).

4. Intellectual Property and Content

• All immersive labs, content, texts, graphics, interfaces, logos, and materials provided through the Platform are protected by intellectual property rights owned by Scalyz or its licensors.
• No ownership rights are transferred to the user.
• Any reproduction, distribution, modification, or exploitation of such content without prior written consent from Scalyz is strictly prohibited.

5. Data, Communications, and Feedback

• Users may submit suggestions, feedback, or comments to Scalyz. Such input may be used freely by Scalyz without obligation or compensation.
• Communications between Scalyz and users may occur via email, notifications on the Platform, or other appropriate means.

6. Modification and Termination

• Scalyz reserves the right to modify, suspend, or discontinue access to all or part of the Platform at any time without notice.
• Scalyz may suspend or terminate a user’s account in the event of a breach of these Terms or conduct deemed harmful.

7. Privacy and Personal Data

• Use of the Platform involves the collection and processing of personal data. Such processing is governed by the Privacy Policy, which the user agrees to review and accept.

8. Limitation of Liability

To the extent permitted by applicable law:

• Scalyz, its directors, employees, and affiliates shall not be held liable for indirect, incidental, or consequential damages, including loss of profits, revenues, or data, arising from the use of the Platform.
• Users remain solely responsible for how they use and rely upon validation reports or other outputs from the Platform.
